1.- Organizing Company
The present raffle is organized and managed by MATIAS SALVÁ S.L. (hereinafter "Matties Bags" or "THE Organizer"), located at Plaza de España, 21-23, 03740 Gata de Gorgos (Alicante - Spain) and with C.I.F. number B 03088366. This raffle is subject to the present rules, in order to reward its customers.
2.- Disconnection from Facebook and Instagram.
Facebook and Instagram do not sponsor, endorse, or administer this promotion in any way, nor are they associated with it. The user completely disassociates from Facebook and Instagram and is aware that they are providing their information to Matties Bags and not to Facebook and Instagram.
The information provided will only be used to process the participant's entry and to notify them of the prize in case they win.
3.- Scope and Duration
The draw will take place for any user residing in Spain, regardless of their nationality, on the official Matties Bags page on Facebook and on their Instagram profile.
The start date of the raffle will be on MARCH 12, 2024, and the end date will be on MARCH 26, 2024, at 12:00 pm.
4.- Requirements to participate
They will be able to participate in the promotion:
- All individuals over 18 years of age residing in Spain, regardless of their nationality, who visit the official Facebook or Instagram page of Matties Bags, have a real user profile on Facebook or Instagram, and meet the requirements established in these bases.
- The use of fake profiles or those created specifically for participation or any form of fraud is not allowed. For this, Matties Bags manages the raffle through a specific application (APP) called Easypromos, which has a system for detecting fraudulent votes and profiles of "professional contestants" and users participating in vote exchange networks. Matties Bags will automatically remove from the raffle those participants who are detected as fraudulent, with no option to claim the prize.
- Participation is free without the requirement of having purchased any product.
5.- Mechanics of the draw
To participate in the promotion, contestants must access the official Matties Bags page on Facebook (https://www.facebook.com/mattiesbags) or on their official Instagram profile (https://www.instagram.com/mattiesbags/)
On the wall of the official Matties Bags page on Facebook and Instagram, a post related to this giveaway will be made where the mention "GIVEAWAY BAG" will be included and the participant must:
-Comment on the post with the hashtag #FeelAmazingEveryday tagging 2 friends.
-Be a follower of the profile in which I participated.
6.- Selection of the winner
The promotional period has ended, and within 48 hours following its conclusion, the selection of 1 winner and 3 substitutes will take place through the Easypromos platform.
7.- Communication to the winner
Once the winner is chosen, between March 26-28, 2024, the Organizer will make a post on their Facebook page and their official Instagram profile informing of the Easypromos link through which participants can check the name of the winner of the raffle.
The winner must contact Matties Bags via private message through the social network in which they participated. Matties Bags will request their personal information for the subsequent delivery of the prize. If 72 hours pass since Matties Bags published the link informing that the name of the winner can be consulted, and the winner has not contacted Matties Bags, or if the winner rejects the prize, the winner will lose their status as winner and the appropriate alternate will be indicated as the winner. The alternate will also be declared the winner if the winning person does not comply with any of the rules established here or does not accept their content.
For each response that the winner must send to Matties Bags, the winner will have a period of 72 hours, after which it will be understood that the winner forfeits the prize, and Matties Bags will proceed to contact the corresponding alternate.
Once the acceptance of the prize is confirmed, the Organizer may publish on the Matties Bags Facebook page or Instagram profile, the Nickname of the winning person and/or the winning comment. Likewise, the Organizer reserves the right to publish them on the Matties Bags website and on other profiles that the Organizer has open on social networks, such as Twitter, Youtube, etc.
8.- Prize
There will be 1 prize and 1 winner of the prize. Once accepted, the winner will receive a prize consisting of 1 handbag with a shoulder strap, yellow, from the "Reunión" series (30*20*12 cm). The prize is personal and non-transferable and cannot be replaced by any other prize or cash. In the event that the indicated product is not available at the time of prize delivery, it will be the Organizer who designates another product to replace the initially raffled one.
9.- Payment of relevant fees and taxes
In accordance with the regulations of the Personal Income Tax, the prize awarded for participation in games, raffles, lotteries, or random combinations linked to the sale or promotion of goods or services is subject to withholding or advance payment as long as the value of the prize exceeds 300 euros. It is hereby informed that the value of the prize in this promotion is in no case greater than 300€.
10.- Causes for disqualification of a participant in the promotion
Matties Bags will automatically and immediately exclude from it any participant who transgresses the rules of good faith, observing deceitful, inappropriate, false, or improper conduct, uses disproportionate, fraudulent, or abusive means, or fails to comply with these rules in any of their aspects.
In any case, by way of example but not limited to, any participant in the promotion will be excluded if any anomaly attributable to a participant is detected that prevents, alters, or disturbs the normal development of the promotion, affects or harms any other participant, may falsify participation data, compromises the security or reliability of the technical systems used for its development, or otherwise contravenes these rules, which will entitle Matties Bags to unilaterally and immediately exclude said participant and report the facts to the competent authorities.
In the event that any of the above irregularities, or any others, are detected after the effective delivery of the prize, Matties Bags reserves the right to take appropriate legal action against the author or responsible party.
11.- Personal data
In compliance with Regulation 2016/679 General Data Protection dated April 27, 2016, we inform you that the personal data provided by the user will be the responsibility of MATIAS SALVÁ, S.L. The purpose of the processing will be to manage the raffle and its winner.
In no case does MATIAS SALVÁ, S.L. consider the transfer of data or the international transfer of personal data to third countries outside the EU. Automated decisions without human intervention will not be carried out either. We remind you of your right to file a complaint with the Spanish data protection authority if you believe that the current legal provisions on data protection have been violated.
As the holder of the rights recognized in the current regulations on data protection, you may exercise the rights of access, rectification, deletion, limitation of processing, portability, and opposition with the legally established limitations, especially those arising from the fact that the commercial action is carried out on social networks owned by third parties by contacting MATIAS SALVÁ, S.L. by postal mail at Plaza de España nº21-23, 03740 Gata de Gorgos, Alicante, or by email at web@mattiesbags.com.
12.- Other considerations:
- Matties Bags is not responsible for errors, interruptions, defects, delays in operations or transmissions, theft, destruction, unauthorized access or alterations of the promotional registration materials, or for any malfunction, poor transmission or error in receiving any information from Matties Bags, as well as for technical errors of traffic, failure or congestion in the Internet connection.
- The simple participation in this promotion implies the acceptance of these terms in their entirety, which can be consulted on the Matties Bags website, so the participant's declaration of non-acceptance will result in their exclusion from this promotion and, as a consequence of this exclusion, Matties Bags will be released from all obligations incurred with the participant.
- Matties Bags is authorized to modify these rules in any provisions that are relevant to ensure the proper functioning of the promotion in the event of detecting fraudulent use of the promotion. Any aspect not provided for in these rules, or any doubt regarding their interpretation, will be resolved at the discretion of the promotion's organization.
- Matties Bags reserves the right to shorten, extend, modify, or cancel this promotion if exceptional circumstances arise that prevent its execution, communicating such circumstances in a way that avoids any harm to the participants in the promotion.
- Matties Bags reserves the right to invalidate, expel, eliminate or disregard those profiles that it considers suspicious of any attempt at fraudulent participation, including, by way of example and not limitation, the attempt to register more than one Instagram or Facebook user profile by a person, creation of fake profiles or identity theft.
- This promotion is governed by Spanish law and these terms and conditions. For the resolution of any dispute that may arise, the participants and the Organizers expressly submit to the jurisdiction and competence of the Spanish Courts and Tribunals in the terms established in Article 52.3 of the Civil Procedure Act.
