(hereinafter Matties Bags) and are intended as a complement to the General Terms of Use of the website, the Privacy Policy, the Legal Notice, and any other legal texts published on https://www.mattiesbags.com


The User is also informed that these terms and conditions have been prepared in accordance with the provisions of Law 34/2002, on Information Society Services and Electronic Commerce, Law 7/1998 on General Contracting Conditions, Royal Decree 1906/1999 regulating Telephone or Electronic Contracting with general conditions in development of article 5.3 of Law 7/1998, and Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, as well as any applicable legal provisions.


The User who purchases products through https://www.mattiesbags.com acknowledges having read these terms and expresses their full and unconditional acceptance of each and every one of them.


The conditions described here may be modified at any time at the request of Matties Bags, so these conditions will only be valid for the purchase made by the User at the time of reading them. Therefore, Matties Bags informs the User that they must read the conditions for each purchase made through this page .

1. IDENTIFICATION OF THE CONTRACTING PARTIES


On one side, Matias Salva, S.L. (hereinafter Matties Bags), with C.I.F. B03088366 and registered office at Plaza España 21-23 (C.P. 03740) Gata de Gorgos and address for notifications at the same address registered in the Mercantile Registry of Alicante, Volume 540, Book 195, Page 140, Sheet 4580.


And, on the other hand, by the User, whose data is entered by themselves in the registration form to make the purchase of any Matties Bags product upon acceptance of these terms and conditions.


2. OBJECT OF THE CONTRACT


The contract aims to regulate the Specific Terms and Conditions for the products marketed by Matties Bags.


The access to information is completely free, while the product purchase service is chargeable, with the current product prices, shipping costs, and tax charges specified at all times.


Additionally, the User, prior to making the purchase, may obtain a complete description of the product and its features, which will also be provided in the "Order Confirmation."


3. SERVICE AVAILABILITY


The products offered through this website will be available in Spanish territory and parts of Europe.


Likewise, the contracting procedure will be carried out in Spanish in all cases, and in English if the user selects that option. Matties Bags may also offer the possibility of contracting the service in other specified languages.


4. PROCEDURES TO ENTER INTO THE CONTRACT AND PURCHASE PROCESS


The product purchase process is carried out entirely electronically through the website. The steps to complete the purchase are as follows:


Product selection:


The User must click on the product they are interested in. The selected product will appear in a larger image, and the User will receive a detailed sheet of the product, showing its own characteristics, the available sizes according to international standards, the product image from different perspectives, if the store decides to provide more information about the product, the price, and any possible promotions, offers, or discounts which will be clearly and explicitly identifiable.


Just click on "ADD TO MY CART" for the product in question to be added to the "CART" and the system will open a side panel where you can "CHECK OUT" or Close (X located at the top right) to continue shopping.

In case you continue shopping, you will see the "my cart" section at the top right of the screen, which will display the number of products added to the mentioned cart.

By accessing the cart, you can log in and view the products you are going to purchase. Once the shipping address is determined, you must choose the shipping method so that the system calculates the shipping cost. Below, we detail the  shipping cost according to order amount:

Additionally, the registration form will request the User's express authorization for Matties Bags to send commercial information related to the brand's products, contests and product giveaways from Matties Bags, promotions, as well as any other advertising information via email. Without prejudice to the informative communication regarding the processing of the User's personal data included in the registration form itself, the User is advised to access the Privacy and Data Protection Policy for more information on this matter.


PAYMENT METHOD:

The User must choose from the different payment methods that Matties Bags offers, which are: credit card, PayPal, Sequra, bank transfer, or cash on delivery.

If the User prefers the credit card option, they must provide the following information:

If the User chooses the PayPal option, they must provide the following information:

If the user chooses bank transfer, it should be noted that their order will be completed once we receive the order amount in our bank account.

If the user prefers to choose cash on delivery, it should be noted that there will be an extra charge indicated above, which corresponds to the management of the cash by the transport agency.

If the User does not wish to enter into the contract and wants to terminate the purchase process, they are requested not to place the order by avoiding clicking "FINISH," all without prejudice to the fact that, if the payment is authorized and the contract is formalized, the User may exercise their right of withdrawal as well as any other rights recognized by law.


The cancellation of the purchase process through the procedure established for such purposes will imply that all the information the User has entered up to that moment - through the different steps of the purchase process and in relation to that specific purchase - will be deleted so that Matties Bags will not retain the indicated data. On the other hand, Matties Bags will retain the User registration data so that the user can expedite their future purchase processes, with it being sufficient for the User to identify themselves through their username and password. The user may at any time modify their information, request to unsubscribe from the service, or exercise the rights of access, rectification, cancellation, and opposition. For more information, the User is advised to consult section 14 of these terms and conditions.


5. CONTRACT FORMALIZATION


There will be no contract between Matties Bags and the User regarding any product until the order has been expressly accepted by Matties Bags (even if the charge has already been made to the bank account provided by the User). If the order is not accepted and a charge has already been made to the bank account provided by the User, the amount will be fully refunded within a maximum period of thirty days.


To place an order, you must follow the online purchase procedure described in section 4 of these terms and click on "PLACE ORDER". After this, you will receive an email acknowledging receipt of your order ("Order Confirmation"). The contract for the purchase of a product between Matties Bags and the User will be formalized only when the User receives the Order Confirmation.


In this regard, the User is informed that all product orders placed through are subject to availability, and, in this sense, if there are difficulties regarding their supply, or if there are no items in stock, Matties Bags reserves the right to provide the User with information about substitute products of equal or higher quality and value that the User may order. If the User does not wish to place an order for these substitute products, we will refund any amount the User may have paid within a maximum period of 30 days.


6. VALIDITY OF THE PURCHASE PROCEDURE AS PROOF OF ACCEPTANCE AND COMPLETION OF THE CONTRACT


Both parties -Matties Bags and the User- expressly declare that by electronically following all the steps described in point 4 for the purchase process of Matties Bags products, it constitutes full and express acceptance of these specific terms and conditions of contract, understood as sufficient to enter into a contract.


7. PRICE AND OFFERS


The price of Matties Bags products that the User can purchase through will always be displayed alongside each product and shown in Euros. The published price is the final full price of the product, which includes all applicable taxes according to current legislation as well as shipping costs or any others that may be charged to the User. In any case, Matties Bags will provide the User with a detailed price breakdown during the purchase process, allowing the User to know the exact amount of the product and the other concepts mentioned above.


Additionally, Matties Bags makes it clear that the Offers, Promotions, and Discounts published will be subject to and limited to the product they are advertised on, the time period established, as well as the other conditions that Matties Bags unilaterally decides to set. In any case, Matties Bags will clearly, visibly, and explicitly indicate the aforementioned information so that the User can distinguish and understand the Offer, Promotion, or Discount.


8. PAYMENT METHOD


The payment method for the order will be the one chosen by the User when placing the order, from among the payment methods allowed by Matties Bags. The User may opt to pay by credit card, Sequra, Paypal, bank transfer, or cash on delivery. Payments can be made with Visa, Visa Electron, MasterCard, Maestro, 4B, Red 6000, and Discover cards. The card used for payment must be owned by the User who purchased the product from Matties Bags. In the event that the credit and/or debit cardholder and the User are different persons, it is an indispensable requirement that the purchase be made by the cardholder. For these purposes, Matties Bags is exempt from any liability arising from non-compliance with this clause, and Matties Bags is not responsible for purchases made by a User with a card owned by a third party.


Payment through PayPal guarantees the confidentiality of the User's card data. In the case of making a payment with a credit card through PayPal from an account not registered with PayPal, the order will not be shipped until the identity of the cardholder who made the order has been verified.


For these purposes, Matties Bags is exempt from all liability regarding the confidentiality and security of the information and data provided by the User when making payments for their purchases via credit or debit card, to the extent that the processing of such information and data is not exclusively under the control of Matties Bags.


9. PRODUCT DELIVERY

The delivery time for products within mainland Spain will depend on the shipping system established with the various transport agencies. In general, the estimated delivery time is between 1 and 4 business days, but occasionally, some products may exceed these estimated times due to various reasons such as assembly, manufacturing, or other similar factors that may extend the shipping time. Matties Bags informs the User that the purchase will be considered formalized once the User receives—at the email address provided during the purchase process—confirmation from Matties Bags that the purchase has been successfully completed. Delivery times outside Spanish territory are generally no longer than 7 business days, although this depends on the destination country.

Matties Bags will deliver its products through the transport agency contracted for this purpose. The product will be sent to the exact address provided by the User in the form completed to make the purchase through our WEBSITE and will be delivered to the street level. Therefore, the User is kindly requested to verify prior to completing the purchase that they have correctly entered their contact details. In this regard, Matties Bags is exempt from any liability in the event that the product delivery cannot be executed or is delayed due to inaccurate or incomplete data, the User's absence, or a Force Majeure event. "Force Majeure event" shall mean all those causes that could not have been foreseen, or that even if foreseen were unavoidable, and that result in the non-fulfillment of any of its obligations. These include, but are not limited to, strikes, both of its own workers and of external workers, insurrections or riots, as well as regulations issued by any civil or military authority, natural disasters such as earthquakes, floods, lightning, or fires, wars, lockouts, or any other force majeure situation.


The User is reminded that under no circumstances will transportation and delivery charges be applied at the time of receiving the product (except when Cash on Delivery is chosen as the payment method).

10. HOW TO RETURN YOUR MATTIES?

If you want to make a return, please contact us through our email web@mattiesbags.com and tell us:

• Preferred time for the agency to pick up the package (This schedule is indicative as the agency will pick up as soon as possible)
• Please let us know if you have the package ready

We will contact you as soon as possible to process the return.

10.1. RIGHT OF WITHDRAWAL
The User may exercise their right of withdrawal - nullifying the contract entered into between the User and Matties Bags - without the need to justify their decision and without any penalty. However, the User must bear the direct costs arising from the return of the purchased product, if any.

The return of products purchased through mattiesbags.com in Spain (Peninsula and Balearic Islands) and Portugal is free of charge. Please note that shipping costs are non-refundable.

The return of products purchased through mattiesbags.com in Germany, Austria, Belgium, Bulgaria, Czech Republic, Croatia, Denmark, Slovakia, Slovenia, Estonia, Finland, France, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Madeira and Azores, Netherlands, Poland, Romania, and Sweden does incur a return shipping cost borne by the customer; furthermore, shipping costs are non-refundable.

The User has a period of fourteen (14) days to exercise their right of withdrawal starting from the moment they receive the product purchased through mattiesbags.com at the designated address. In November and December, we extend the return period until January 10.

The User must return the purchased product to Matties Bags in perfect condition, and the right of withdrawal will be denied if the product has been used or damaged by the User.

Once the right of withdrawal has been exercised, the User will receive an email confirming the acceptance (if the returned order is correct) of the return, and Matties Bags will proceed with the refund. Matties Bags will refund the user to the same bank account through which the payment for the purchased product was made, for the amount the User paid for the product as reflected in the "Order Confirmation." Matties Bags will process the refund as soon as possible and, in any case, within thirty (30) days from the date Matties Bags receives the document through which the User exercises their right of withdrawal.

11. RETURNS OF DEFECTIVE PRODUCTS

In cases where the User, at the time of delivery, considers that the product does not comply with the terms stipulated in these conditions, they must contact Matties Bags immediately by sending an email to web@mattiesbags.com providing the product details as well as the damage it has suffered, or by calling the phone number +34 965 756 051.

The User must return the product to the address indicated in the first section of these terms and conditions.

Matties Bags will carefully examine the returned product and notify the User at the email address provided for this purpose, within a reasonable time, whether the return or replacement of the product is applicable (if applicable). The return or replacement of the product will be carried out as soon as possible and, in any case, within 30 days from the date we send an email confirming that the return or replacement of the non-compliant item is approved.

The amounts paid for those products that are returned due to any defect or flaw, when it actually exists, will be fully refunded to you, as well as any costs incurred by the User to return them to us. The refund will be made to the same credit card used to pay for the purchase.

The rights recognized by current legislation remain unaffected.

12. WRITTEN COMMUNICATIONS

The information or communications that Matties Bags sends to the User will be in writing. The User agrees that communications with Matties Bags will be electronic. For contractual purposes, the User consents to using this electronic means of communication and acknowledges that any contract, notification, information, and other communications that Matties Bags sends electronically meet the legal requirements of being in writing. Notifications sent by the User should preferably be made to the contact addresses published in the "CONTACT" section of mattiesbags.com.


13. CLAIMS SUBMISSION

The User may submit complaints and claims or request information about the products offered or contracted through Matties Bags via the following channels:

Matties Bags will respond to the User as soon as possible and in any case within a maximum period of one month from the submission of the claim.


14. DATA PROTECTION

According to Organic Law 15/1999 on the Protection of Personal Data (LOPD), the User, as a contracting party, acknowledges being informed and consents that their personal data generated during the execution of the contractual relationship will necessarily be processed in a file managed by Matties Bags for the purpose of carrying out the management, development, fulfillment, and control of the contractual relationship, as well as postal or electronic sending of communications and documentation related to said relationship, contact agenda, and maintenance of commercial relationship histories. The data will be transferred to other third parties in legally provided cases such as financial auditors, competent Administrative Bodies for reasons of control, registration, and inspection.


Likewise, from the moment the User carries out a purchase process and validly formalizes the contractual relationship with Matties Bags, their personal data will be stored in a file managed by Matties Salva (Matties Bags) for the following purposes: to carry out the management, development, fulfillment, and control of the contractual relationship, management of the order placed, identification as a Matties Bags customer, sending and customization of documentation related to the business relationship, providing access via username and password to the specific web area for registered users; contact agenda as well as proper economic, accounting, and tax management; invoicing and administration; development and management of the commercial relationship with customers and maintenance of commercial relationship histories. The communication of data by the interested party for the fulfillment of the aforementioned purposes is mandatory, and by virtue of the contractual relationship, their data may be transferred to the following entities: Judges and Courts, if legally required or consumer arbitration courts, as well as consumer associations in case of dispute, banking entities for the collection of the purchased product, Tax Agency for compliance with tax obligations, and any other third parties to whom, under the stated regulations, it is necessary to transfer data to ensure the proper development of the contracted service and, in general, the intended purposes.


Likewise, Matties Bags informs the interested party that their data may be transferred to other third-party companies subcontracted by Matties Bags to collaborate in the total or partial execution of the services to be provided.


The User agrees to inform Matties Bags of any changes to the data while the contract is in effect so that the said entity can proceed with its update. Unless otherwise communicated to Matties Bags, it will be understood that the data provided by the User is accurate and current.


For its part, if during the execution of the contract the User must provide personal data relating to third-party individuals, they must, prior to its inclusion, inform said third parties of the details contained in this communication and, in any case, of the purpose of the transfer. For these purposes, the communication of third-party personal data is subject to the principles of necessity and proportionality and to the communication of current and truthful data, and requires prior notification and consent from said third parties for the processing of their data unless there is a legal authorization for this purpose.


Finally, the User is informed that, in the event they expressly authorize the receipt of advertising mailings through the registration form, their data will be processed for the purpose of sending advertising and commercial information related to the products marketed by Matties Bags, as well as information about promotions and contests organized by Matties Bags, to the email address provided by the User.


Under the protection of articles 21.2 and 22.1 of the LSSICE, the User is informed of their right to object to the processing of their data for promotional purposes for receiving commercial communications, as well as their right to revoke the consent given at any time by simply notifying their will to Matties Bags.


To do so, the user may submit their objection by sending an email to the address: web@mattiesbags.com, with the subject "OPPOSITION LSSICE", as well as the right to revoke their consent by requesting to unsubscribe from the commercial communications service via email by sending an email to the address: web@mattiesbags.com, with the subject "UNSUBSCRIBE".


Likewise, Matties Bags informs the user of the possibility to exercise their rights of access, rectification, cancellation, and opposition by submitting a written request addressed to Matties Bags at the following address: Pza. España, 21-23 - CP: 03740 Gata de Gorgos (Alicante), or any other address that replaces it and is communicated in the General Data Protection Registry. For these purposes, the interested party must send Matties Bags a written communication indicating the request or right they are exercising along with a copy of their ID card or a legally valid document that proves their identity. The User can also exercise their rights by sending a photocopy of both sides of their ID card - or an equivalent document - to the email address web@mattiesbags.com.

15. APPLICABLE LAW, JURISDICTION, AND OUT-OF-COURT DISPUTE RESOLUTION


These general conditions are governed by Spanish law.


The parties, expressly waiving their own jurisdiction, submit to the Courts and Tribunals of Denia (Alicante) Spain and, where applicable, the Arbitration Tribunals to which Matties Bags is affiliated at the time the dispute arises, for the resolution of any disputes that may arise.
